Roller Skating Release & Acknowledgement
In consideration of permission to use, today, and on all future dates. Wheels of Thunder Family Roller
Skating Rink Facilities and services(“Facilities”), I, The undersigned (“Skater”), hereby expressly agree:
- That roller skating is a participation sport and Skater and/or Skater's guardian is fully aware of
the risks and hazards involved in or arising from his/her use or presence upon the Facilities.
SKATER AND/OR SKATER'S GUARDIAN HEREBY ASSUMES ANY AND ALL RISKS INVOLVED IN OR
ARISING FROM SKATER'S USE OR PRESENCE UPON THE FACILITIES, including, without limitation,
the risks of bodily injury resulting from collision between Skater and another person or a
stationary object or the negligent or deliberate acts of another person.
- That Skater is medically fit to participate in strenuous on-rink or off-rink activities. As stated
above, participation in roller skating activities presents an inherent risk of injury to person or
property. Skater and/or Skater's guardian certifies that Skater has no known conditions that
prohibit or limit participation in roller skating. Skater has a current health/hospitalization
insurance policy in full force and effect to cover any injuries sustained while participating in
activities at the Facilities.
- That Skater has been given a copy of and read or been read the Code of Conduct presented to
Skater. Skater will abide by the Code of Conduct at all times. Skater and/or Skater's guardian
acknowledge that failure to abide by the Code of Conduct may cause injury to Skater or other
roller skaters using the Facilities and assumes responsibility in the event of such an occurrence.
If Skater notices someone else not following the Code of Conduct, Skater will immediately
inform an employee of the Facilities.
- TO RELEASE THE FACILITIES and all of it successors, assigns, affiliates, officers, directors,
employees, and agents from, and AGREES NOT TO SUE ANY OR ALL OF THEM on account of or in
connection with any claims, causes of action, injuries, damages, cost of expenses (collectively
“Claims”) arising out of Skater's use of or presence upon the facilities, or use of this rink's skates
or equipment, including but not limited to those claims for bodily injury. This release is subject
to the limitations imposed by MCA 28-2702.
- That In-line and Quad roller skates are permitted. All personal skates must be rink-safe, meaning
that their use must not gash, indent or blemish the skating surface or any other surface in the
building. It is the responsibility of Skater and/or Skater's guardian to ensure that all personal
equipment and personal skates used by Skater are rink-safe and unable to cause injury to
property or person(s).
